(1)买卖合约中提到具体船名,卖方保证船舶可以进入任何一个合约上提到的港口
(2)第一次由于吃水问题不能进港,故而卖方违反其(1)保证而船舶没有做好卸货准备,故而不能递交有效的NOR以起算装卸时间
(3)第二次进港靠泊后发现了害虫,货物需要熏舱并不影响船舶在各方面的备妥,提交的NOR有效可以起算装卸时间
(4)由于有一条免责条文,熏舱属于 intervention of sanitary 故而装卸时间起算后马上停算,直至取得无害证明
The charter-party further provided in cl. 5:
The cargo . . . to be discharged at the rate of 750 metric tons per clear working day of 24 consecutive hours Sundays and Holidays and bad weather always excepted . . . calculation of time at each end shall be based on weight inserted in Bill of Lading.
6. Time . . . for discharging (to count) from 8 a.m. on next working day after ship is reported and in every respect ready and in free pratique, and written notice tendered whether in berth or not. Steamer to be reported during official hours only.
