In respect of one distribution agreement between a company located in mainland China and another company in Namibia, Africa, it is provided in the agreement that " in case of breach of any of the terms of this agreement by either of the parties, relevant international laws shall be applicable", no more clause is provided in respect of the arbitration. The Namibia company has lodged a litigation against us for object amounting to about USD 1 billion in Namibia, are we in position to initiate an arbitration over this issue? If yes, do we have to reach more agreement about the place of arbitration? Can such arbitration award be enforced in Namibia when no more agreement can be reached about the arbitration? Or do your have more suggestions for us? Your quick reply will be highly appreciated.
