杨老师,你好,我遇见到麻烦事情麻烦您帮忙解答,我跟重吊船东签定装卸两港给48小时的时间,装卸率是CQD,代理和码头都是船东指定的,现在船到前2天我们跟代理落实可以直靠,本来可以有时间安排我们自己合作的码头,但是代理确定可以直靠我们就没有采取相应的行动,现在船已经到了,但是船又靠不上了,而且已经用完了相应的合同规定时间,想问下这种情况下船东是否可以跟我们收取滞期费?我们想要不交这部分费用要采取什么方式来应对船东? 多谢了

这个问题有内部矛盾,48小时与CQD是相互矛盾的,可以说是定合约的双方都有点不了解。如果在合约/租约中同时出现这两个词,就要看哪个词是更具效力可去超越另一个起直接矛盾的词语,这就要看我的书《合约的解释》。如果最终也是分不清哪个词更overriding,起码也给了可以与船东讨价还价的基础,例如滞期费一人一半。如果代理是船东的代理,不能直接靠码头如果是他的错,你也可以以此与船东讨价还价,因为船舶延误是船东代理所造成。但如果船东代理的过错并不明显,晚了去告诉船长或船东代理有关指定的码头就会有可能是要你作为承租人承担后果。

现在合同规定船东指定码头和指定代理,上海港口有很多码头,我们跟另外的码头沟通可以靠泊,但是船东指定的码头却是很拥挤,但是船东不同意我们指定的码头,我们提前都有跟代理沟通,船代一直说可以直靠船东指定的码头,这样产生的滞期也应该我们来承担吗? 多谢老师不吝赐教!!(现在装卸时间已经用完了,进入滞期时间)

Pls kindly refer to the timetable these days regarding this shipment first:

- 6th Apr, we rcvd the mail saying the vessel will arrive at 12th, and the ship agency agree to arrange the berthing instantly
- 9th Apr, rcvd the mail saying the vessel will advance to arrive at 11th afternoon, and the ship agency promise to arrange the berthing once she arrived
Meanwhile, we also contacted Terminal 10 for the direct berthing issue which we often cooperate and have good relationship with; just to avoid any delay on berthing. And we communicated with your ship agency that suggests berthing at Terminal 10 instead of Terminal 14 which has some congestion theses days. But they said it’s no problem for Terminal 14 and they guarantee the direct berthing once again. So we accepted their original plan.
- 12th Apr, we sent all our cargoes alongside the terminal and waiting for the berthing but in vain. Then we called ship agency and got the reply that Terminal 14 is in congestion now!
At the mean time, we contacted terminal 10 and get the answer that they still could arrange direct call instantly. Then we sent mail to ownr and suggest changing the berthing to Terminal 10 to avoid time loss, but the answer was still kept unchanged.
- 13th,Apr, we were still trying our best to find solution to make the vessel berth asap, but ownr still answered to call Terminal 14
- 14th Apr finally get the notice of the berthing plan was made and the ETB is 15th Afternoon.

Now, we’re facing the detention of the heavy-load trucks which amounts about 4,000 USD per day. Also, we have to face the possible detention of the vessel which had been already occurred and might continue to account in the following days.
But we think that it’s the problem of the ship agency who haven’t exert due diligence when arranging for the berthing plan and directly lead to this unexpected result! And we should have avoided so much time and the economical loss if the good communication was held between us and the back-up berthing plan was held. So we feel so sad against this happening, and pls comment accordingly.
这个是大概的事情原委!请问杨老师,根据以上情况DETENTION是否可以免除?
