关于改港运费计算条款中,“without counting of repositioning advantages/disadvantages”或类似的wording,我想向您请教几个问题:
1. repositioning具体怎么理解?
是船的空载港与最终卸港之间的位置比较吗?如果空载港在欧洲,卸港是中国港口,这种情况是不是就没有必要规定with or without repositioning?
2.如果运费价格bss Tub/QD,实际装、卸港是Tub/Caofeidian,条款中没有对repositioning的规定,船东有可能会跟租家收Tub/Caofeidian段;那如果运费价格bss Tub/QD,实际装、卸港是Tub/Baoshan,这种情况下对船东有利,租家可否在计算时减掉Baoshan-QD段?
3.Rio Tinto范本合同中的条款是:The alternative discharging port (s) freight calculation shall be conducted on an open book basis commencing from the vsl's previous discharging port and without consideration for repositioning (i.e. last to next basis). 这里的last和next指的是什么?是上一卸港和本航次的卸港吗?
