As usual all the alumina shipment out from Bunbury or Gladstone to Bluff the
OBL is signed by disch port agent (Pacific Shipping Agencies Ltd).
Please be advised that the reason we do this is because the cargo that
loaded on board your good vessel is sell to our own smelters and due to
short transit time of vessel from Gladstone to Bluff and to ensure the OBL
will be available for discharging instead of discharging against the LOI.
Fyi, please find attached authorisation letter from our other time charter
vessel that recently loading at Bunbury port.
Plsd to hear your confirmation to authorise the disch port agent on behalf
of load port agent to sign the OBL on behalf of your good self.

Head-Charterer to Owner:
Since headowner requested for our view, then we humbly comment that
place of issuance of bills of lading is not restricted to load port
only. It can be issued at any other place other that the load port,
the same principle which work on switching of bills of lading whereby
2nd sets bills is often issued/exchanged at a place other than the
load port which is a common shipping practice. We checked same with
our PNI Club before and we allowed such practice. Load port agent or
Discharge port agent, not withstanding are both appointed agent of our
subtc, in this case Rio Tinto.
Either agent, without the final approval of Rio Tinto will not be
allowed to sign/release bills so regardless of load port agent or
discharge port agent signing the bills, the control remains with
owners, in this case, Rio Tinto acting as Time-Charter owner.
Headowner may wish to check with their PNI Club and advise their final
position on subject matter as this will means we will never be able to
use Nona Bulker for some cargo which strictly requires Bills of Lading
to be issued at discharge port by the discharge port agent, who is a
subsidiary of the receivers.
