扬教授你好!现有个问题请教, 我公司TCT租进一条船,Vancouver, BC 装货,去Santos, Brazil 卸货, 途径Magellan Strait. C/P 写明:“Chtrs will provide compulsory and customary pilotage” Master requested entire pilotage in Magellan Strait (i.e. compulsory + non-compulsary) due to safety reasons. 请问 if Chtrs should pay for non-compulsary pilotage in Magellan Strait i.e. in this case, should the non-compulsary pilotage be considered as customary pilotage as per C/P.

根据《Chitty on Contract》的12-129段,除非一个做法是人尽皆知的(notorious)、肯定(certain)、合理(reasonable)并且与法律没有冲突,否则不会被法院认定是习惯做法。至于一个做法是不是人尽皆知这个要根据事实证据来判定,仅仅是贸易惯例(trade practice)是不够的。

Thanks for your comments and noted. However, in reality, for non-compulsory pilotage in Magellan Strait, some of vessels need pilot, and some of them do not. It depends on the weather condition and whether captain has the experience to transit the strait etc. So it would be helpful to have some cases.
