ONCE CARGO ONBOARD, FRT DEEMED EARNED AND NO RETURNABLE AND DISCOUNTLESS.
10.  AGENT: CHARTERER`S AGENT AT BENDS WITH REASONABLE P/D  APPROVED BY OWNERS.
11. OWNS/MASTER/AGENT TO INFORM CHTRS/SHIPPER/CONSIGNEES 5/4/3/2/1 DAYS BEFORE ETA NOTICE. AT DISCHG PORT OWNS/AGENT TO INFORM CHTRS DAILY DISCHG REPORT.
12. FOR L/D PORT, MASTER HAS RIGHT TO TENDER NOR TO CHTRS/SHIPPER/RECEIVER/AGENT BY TEL/TLX/EMAIL /CABLE, ETC. DURING DAYTIME MONDAY TO SUNDAY UPON VSL'S ARRIVAL 1ST PILOT STATION AND/OR ANCHORAGE W.W.W.W. IN CASE BERTH IS NOT AVAILABLE WHEN VSL ARRIVES VSL HAS RIGHT TO TENDER NOR ON ARRIVAL ANCHORAGE AND/OR COMMON WAITING PLACE W.W.W.W. DURING OFFICE HOUR. TIME USED FOR LOADING BEFORE LAYTIME COMMENCEMENT SHALL COUNT AND TIME LOST IN WAITING FOR BERTH SHALL COUNT AS LAYTIME OR TIME ON DEMURRAGE. LAYTIME COMMENCE TO RUN 1300HRS IF NOR IS TENDERED BEFORE NOON. OTHERWISE, 0800HRS ON NEXT WORKING DAY.
13. DUNNAGE/SEPARATION IS NOT NECESSARY AS PER PRACTICE OF LOADING TAPIOCA CARGO. HOWEVER IF CHTRS REQUIRED, SAME BE FOR CHARTERERS ACCOUNT.
14. LIGHTERAGE / SHIFTING/ LIGHTENING AT BENDS IF ANY TO BE FOR CHARTERERS ACCOUNT AND ARRANGEMENT.
15.  OWNER GURANTEE VESSEL GEAR IS IN GOOD CONDITIONS AND FREE TO CHTRS/SHIPPER USE, IF FAIL SHORE CRANE AT LOADING PORT TO BE FOR OWNER A/C, IF NEED INDEED.  AT DISPORT USE SHORE CRANE FOR DISCHARGING AND CHARGE AT CHTRS'S ACOOUNT.
16.  OAP IF ANY CHARTERER'S ACCT.
17. ANY TAXES/DUES ON CARGO TO BE FOR CHARTERERS ACCOUNT. SAME ON VSL/FREIGHT TBF OWNERS ACCOUNT.
18. QUANTITY OF CARGO TO BE DECLARED ON M/R AND B/L TO BE DETERMINATED BY INDEPENDENT DRAFT SURVEY AGAINST MASTERS' JOIN SURVEY AT LOAD PORTS.SHIPOWNER MUST UNDERTAKE THAT VESSEL IS IN QUALIFIED CONDITIONS  FOR CONDUCTING DRAFT SURVEY
19.  DRAFT SURVEY EXPENSES TO BE FOR CHTR ACCT BENDS, TIME NOT COUNT AS LAYTIME.
20.  VSL'S HOLDS MUST BE CLEANED/DRIED AND PASSED SURVEY BEFORE LOADING.
21. CARGO FUMIGATION TO BE FOR CHARTERERS ACCOUNT. OWNS/MASTER APPROVED FOR CHTR TO ARRANGE QUICK FUMIGATION AS PRACTICE OF TAPIOCA LOADING EX VIETNAM, EXPENSE INCLUDING  CREW TRANSFERRING/ LODGE /FOOD N TIME USED FOR FUMIGATION AT L/P TO BE CHTRS A/C.  IF REQUESTED AT DISC PORT, OWNERS TO ALLOW MAX 12 HRS FREE BUT THE FUMIGATION COST AT CHTRS A/C.
22. IN CASE ORIGINAL B/L NOT ARRIVE AT DISHG PORT BEFORE COMMENCEMENT OF DISHG, OWNRS AGREE TO DISCHG CGO AGAINST CHTRS SINGLE LOI IN OWNRS PNI WORDING AND CGO TO BE DISCHARGED INTO BONDED WAREHOUSE/STACKYARD UNDER CUSTOMS CUSTODY. ENTIRE CGO TO BE RELEASED AGAINST PRESENTATION OF ORIGINAL BILLS OF LADING ONLY.
23. ARBITRATION IN HK AND ENGLISH LAW TO APPLY.
24.  OTHER TERMS AND CONDITIONS AS PER GENCON C/P 1994
25. ALL LAYTIME TO BE BASED ON WORKING DAYS OF 24 CONSECUTIVE HOURS, WEATHER PERMITTING. IN THE EVENT THAT THE VESSEL IS WAITING FOR LOADING OR DISCHARGING BERTH, NO LAYTIME IS TO BE DEDUCTED DURING SUCH PERIOD FOR REASONS OF WEATHER UNLESS THE VESSEL OCCUPYING THE LOADING OR DISCHARGING BERTH IN QUESTION IS ACTUALLY PREVENTED FROM WORKING DUE TO WEATHER CONDITIONS IN WHICH CASE TIME SO LOST IS NOT TO COUNT.
